Judicial Review To Retain Aircraft Noise Insulation Provision:

​

We represent Residents of Fingal and East Meath, with the support of FORUM and SMTW Environmental DAC. We have the support of community groups impacted by substantial aircraft noise in and around Dublin Airport including but not limited to areas such as; St Margaret's, The Ward, The Naul, Ballyboughal, Swords, Portmarnock, Baldoyle, Howth, Malahide, Skerries, Rush, Newtowncross, Coolock, Clonshaugh, Lusk, Donabate, Kilsallaghan, Rolestown, Oldtown, Portrane, Ashbourne, Ratoath, Coolquay and the Wotton.

 

As part of the Fingal Development Plan 2023-2029 a motion was submitted by Councillor Ann Graves and unanimously approved by all Councillors

 

"That the Development Plan recognises the inadequacy of the proposed noise insulation scheme to protect the health of those affected by aircraft noise and that in view of the increasing knowledge and scientific evidence of the serious health impact of aircraft noise on the physical health of Fingal residents that it is an objective to take measures including the expansion of noise insulation schemes operated by DAA to include all areas exposed to 40dB Lnight or higher as produced by aircraft during night time. "

 

The insulation schemes should be designed to ensure that internal noise levels are in keeping with BSI Standards Publication BS 8233:2014 Guidance on sound insulation and noise reduction for buildings, table 4: Indoor ambient noise levels for dwellings, as referenced in Chapter 14: Development Management Standards of the Development Plan 2023-2029.

 

This approach is in response to the knowledge that night-time aircraft noise above this level is associated with adverse effects including increased mortality, stress, high blood pressure and a deterioration in cardiovascular health"

The motion amended a previous motion by Councillor Brian MacDonagh, and following concerns raised by Fingal County Council and the Office of the Planning Regulator (OPR) the Councillors amended the text to allow for mitigation measures within the 40 dB Lnight contour to ensure that the internal noise levels are in keeping with the BS 8233:2014 guidance on sound insulation and noise reduction for buildings. The 40 dB Lnight contour is the level set by the WHO, "as nighttime aircraft noise above this level is associated with adverse effects on sleep".

 

The BS 8233:2014 standard is already mentioned in the Development Plan as it was used to form the guidance of the planning Noise Zones. This guidance is there to ensure properties are built to a standard that protects residents from the adverse effects of noise pollution.

 

The Planning Authority has designed the Noise Zones based using the British Standard BS 8233:2014. It is wholly appropriate and consistent that the proposed amendment also references these guidelines and ensures the health and safety of residents.

 

The HSE Public Health made a submission on the Development Plan and endorsed the motion added by the Councillors. The HSE concluded that:

"HSE Public Health Area A strongly supports the development and implementation of measures to mitigate against excess aircraft noise, and advocates that such measures are expedited insofar as possible".

​

The public consultation process was also flawed as the draft Ministerial Direction referred to the old amendment from Councillor MacDonagh instead of the revised amendment from Councillor Graves. Submissions were made pointing out this error but were ignored.

Also no SEA screening was carried out on the revised amendments of the Development Plan and therefore the process is in contravention of the Aarhus Agreement.

​

It's imperative that a Judicial Review is taken to overturn the decision to exclude Councillor Grave's amendment. The Development Plan is the appropriate place for such an amendment to provide protection to residents living in the area governed by the Development Plan. There is no other platform for residents to seek protection. The current insulation scheme only provides insulation for those exposed to greater than 63dB LAeq daytime noise. There is no insulation scheme for nighttime noise which is a greater risk to resident's health.
